Seven years of litigation and, for now, not yet final — but we have done it! On 25 February, the Regional Court in Warsaw ruled that Kaja Godek must apologise to 15 people for the use of socially unacceptable hate speech against LGBT+ persons. The claimants were represented by legal counsel (radca prawny) Wojciech Kozłowski and trainee advocate (aplikant adwokacki) Radosław Żygadło, and the case was among the most difficult. Yesterday’s judgment, like the earlier judgment of the Court of Appeal in Warsaw in the same case, sets a new, much stronger standard for the protection of personal rights. The key point is that the courts departed from their earlier, narrowing interpretation and held that an infringement of personal rights may also occur when unacceptable content and assessments relate to a group of persons. Every victory is a joy, but this one especially so, because it means a precedent-setting judgment in a case crucial to the defence of human dignity. 👏👏👏
